Mengemukakan Seekor Lagi Kambing Korban ... Bagi Menanggung Salahlaku 1MDB?

Perdana Menteri Malaysia Najib Razak telah menunjukkan bahawa dia tiada sebarang masalah mengubah-ubah ceritanya apabila versi terdahulunya didapati tidak dapat dipertahankan atau bohong.

Dan ianya semakin jelas bahawa saat dan ketika mara dengan pantas untuk mengubah-ubah cerita 1MDB.

Lagipun, sejak kebelakangan ini Najib dan jurucakapnya dari syarikat itu, Arul Kanda Kandasamy, telah mempertahankan bahawa tiada sebarang masalah pada dana itu. Secara berkategorinya, tiada wang telah disedut ke luar dan dipindahkan ke pihak lain seperti ‘Penasihat Khas’ Jho Low.

Orang-orang kanan telah dipecat dari jawatan mereka dan orang-orang biasa di Malaysia telah ditahan kerana menunjukkan salahtadbir dana itu.

Namun, masyarakat antarabangsa kini melihat masalah dengan lebih dekat dan teliti, disebabkan jumlah wang terbabit adalah terlalu besar. Pihak-pihak berkuasa Switerland, Singapura dan US, kini sudah mempunyai bukti yang mencukupi untuk menunjukkan wang itu sememangnya dikeluarkan dari 1MDB dan jumlah yang dinyatakan oleh Peguam Negara Switzerland adalah sekurang-kurangnya US$4 billion.

Pihak-pihak terbabit yang bertanggungjawab di luar negara (seperti bank-bank) yang sedang disiasat kerana membantu dalam usaha mencuri. Memandangkan Najib begitu degil dan begitu bersungguh-sungguh menutup siasatan-siasat ini dengan memecat dan menahan para penyiasat, dia memerlukan taktik lain.

Andaian-andaian di KL adalah bahawa Najib akan mengunakan cara yang lama – menyembelih kambing korban untuk dipersalahkan bagi melindungi orang yang paling tinggi dalam kedudukan itu. Mangsa korban itu adalah bekas CEO 1MDB, Shahrol Halmi, yang satu-satunya saspek yang masih tinggal di dalam negerinya (saspek yang lain telah lama meninggalkan Malaysia).

Shahrol Halmi telah dibenarkan untuk ditemubual oleh PAC pada sesi terakhirnya minggu lepas, sebelum Pengerusi yang dilantik oleh Najib mengumumkan penutupan siasatan secara mengejut ke atas 1MDB.

Shahrol Halmi merupakan CEO pertama di dana yang dirundung skandal itu, mula menjawat jawatannya pada bulan Mei 2009 dan terus memacu pengurusan dana itu sehingga 22hb Mac 2013. Tarikh ini amatlah menarik, kerana 21hb Mac merupakan hari di mana pindahan wang kali pertama sebanyak US$620 juta dimasukkan ke dala akaun AmBank Najib dari Falcon Bank milik Aabar di Singapura.

Selebihnya yang berjumlah RM2.6 billion masuk beberapa hari kemudian.

Ini bermakna bahawa SEMUA urusniaga yang meragukan yang sedang disiasat berhubung 1MDB, menerusi Kepulauan Cayman dan menerusi ‘pembelian tenaga’ dan ‘usahasama berstrategik’ dengan syarikat pelaburan penyangak dari Abu Dhabi iaitu Aabar telah dimeterai bersama dengan Sharol Halmi.

Namun dengan pemergian sekutu-sekutunya seperti bos SRC dan Ketua Pegawai Pelaburan 1MDB Nik Faisal Ariff Kamil telah lama meninggalkan KL, Shahrol terus bertahan, dilihat dapat merasakan dia berada pada kedudukan selamat pada jawatan barunya di dalam pejabat Perdana Menteri yang mengawas ‘unit prestasi’ PEMANDU.
Pada pandangan orang lain, yang berbisik di sekitar KL, Shahrol dilihat tidak berganjak dari KL, sebagai menunggu masa untuk dikorbankan.

Apabila skandal itu tercetus buat pertama kalinya, Najib telah bertindakbalas dengan mata yang terbeliak pada tuduhan yang mengatakan bahawa wang telah disedut keluar dari 1MDB oleh rakan karibnya Jho Low. Dengan amat yakin dia mengumumkan bahawa Jho Low tiada peranan langsung dalam 1MDB dan bahawa dia sendiri hanya merupakan pemantau jarak jauh, iaitu sekadar sebagai Pengerusi Lembaga Pengarah.

Dengan begitu yakin Najib telah membenarkan banyak pihak penguatkuasa dipelawa untuk melakukan siasatan mereka – empat buah task force telah dilantik dan Najib dilihat begitu yakin bahawa dia boleh mengawal kegiatan-kegiatan mereka yang kemudiannya cukup untuk menutup skandal itu dalam sedikit masa lagi.

Namun hasratnya tidak semudah dijelmakan begitu sahaja, dengan pada penyiasat telah mula mendedahkan lebih banyak maklumat. Telah ditimbulkan, sebagai contoh, Najib sebenarnya merupakan pemegang utama saham-saham dalam dana itu dan juga selaku penandatangan tunggal – dan dianggap sebagai pembuat keputusan mutlak pada setiap kegiatan dana itu.

Emel berikut daripada peguam 1MDB di Wong Partners kepada para peguam PetroSaudi pada majlis pemeteraian usahasama, menunjukkan bagaimana Najib selaku pengawal (lihat Section 4 berhubung Form A, menunjukkan pewaris JV bagi akaun-akaun bank yang relevan).

We thought that it would have been on the letterhead of PetroSaudi Holdings (Cayman) Ltd. We understand from Patrick that the logo of PetroSaudi International Limited appears on the letterheads of all the companies, and they only change the footers of the letters for different companies.

Can you please confirm that Loan Repayment Demand letter is issued by PetroSaudi Holdings (Cayman) Ltd, and not PetroSaudi International Limited.

  1. JP Morgan’s Form A

Further to my email today (attached), could you please confirm that Tarik, HRH Prince Turki and the Minister of Finance Inc are named as the beneficial owners of the joint account in Form A because they are the ultimate beneficial owners of the shareholders of the JV Company. Presumably, it is JP Morgan’s requirement to name the ultimate beneficial owner of the account (and not the intermediaries).

Could you please also send us the revised Form A as suggested in the attached email

Seterusnya, maklumat yang dibocorkan mengatakan bahawa para penyiasat 1MDB telah berjaya mengesan pergerakan RM2.6 billion yang dimasukkan ke dalam akaun peribadi Najib dan RM42 juta telah dimasukkan ke dalam akaunnya yang lain dari 1MDB/anak syarikat Kementerian Kewangan, SRC.

Mula-mulanya Najib menafikan laporan dan menyekat Sarawak Report dan mengancam Wall Street Journal. Kemudian dia mengakui menerima wang itu ke dalam akaunnya, namun mendakwa wang itu datangnya dari seorang “penderma”. Dakwaannya yang terkini adalah bahawa “penderma” itu merupakan putera Raja Arab Saudi (bukan direkodkan sebagai Putera Turki, pemilik usahasama PetroSaudi yang selaku rakanniaga 1MDB).

Najib seterusnya, secara mengejut, mengumumkan bahawa kebanyakan wang itu telah “dikembalikan” kepada “pendermanya”, setelah kita mengandaikan dia tidak dapat menafikan laporan SR bahawa Najib telah mengosongkan akaun ini di Singapura sebaik selepas pilihanraya.

Akhirnya, satu lagi perkembangan baru yang berkisar pada cerita adalah di mana Najib telah mengakui bahawa RM42 jua itu telah diletakkan di dalam akaunnya, tetapi dia tidak tahu siapa yang melakukannya. Dia juga tidak menyedari bahawa wang itu datang dari SRC International. Namun, kertas-kertas siasatan yang dikibar-kibarkan di hadapan kamera-kamera para wartawan, oleh Peguam Negara, mengesahkan bahawa wang bermisteri itu telah digunakan untuk membiayai bil-bil kad kredit Najib Razak.

Nik Faisal Ariff Kamil merupakan pengendali semua bayaran-bayaran dari SRC. Lagipun dia mempunyai kuasa guaman ke atas semua akaun yang relevan yang milik Najib dan merupakan orang yang bertanggungjawab memindahkan wang dari SRC di mana dia juga selaku CEO di syarikat itu (bernaung di bawah Kementerian Kewangan).

Dalam pada itu, Wall Street Journal tampil semula pada minggu ini untuk menyokong kenyataan-kenyataan dari blog ini dan yang lainnya bahawa RM2.6 billion, yang dimasukkan berasingan ke dalam akaun Najib daripada Falcon Bank milik Aabar, semua menunjukkan sebagai berpunca dari 1MDB, bukannya dari hartawan di kalangan keluarga di-raja Arab Saudi.

Ianya tidak dapat membantu cerita Najib bahawa Putera Turki tidak dikenali sebagai seorang hartawan dan bahawa dia sendiri telah menyokong secara rahsia dengan pembiayaan sebanyak US$77 juta kerana membenarkan PetroSaudi digunakan sebagai “syarikat cangkerang” bagi memudahkan Jho Low merompak US$1.83 billion … maknanya penjelasan yang baru akan timbul tidak lama lagi.

Seseorang harus dpersalahkan kerana menghilangkan wang 1MDB dan kemudian membiarkan Najib untuk memikirkan bahawa dia telah diberi sejumlah wang yang banyak dari derma Arab Saudi.

Sebaik sahaja orang itu telah dikenalpasti dan ditunjukkan sebagai telah menandatangi semua dokumen yang berkaitan, maka mudahlah untuk menjelas, dari kedudukannya yang tinggi, Najib boleh mengatakan dia tidak tahu apakah yang dilakukan oleh para proksinya?

Emel-emel dan dokumen-dokumen berkaitan urusniaga PetroSaudi menunjukkan Shahrol Halmi adalah sekadar orang hadapan dalam urusniaga itu.

Namun ini tidak menghalangnya memikul cemuhan itu, kerana dia memikul tugas untuk memacu resolusi dalam Lembaga Pengarah dan menandatangani pindahan-pindahan wang itu.

Menurut emel-emel yang diperolehi oleh Sarawak Report, rancangan usahasama PetroSaudi merupakan idea antara Jho Low dan Pengarah PSI Patrick Mahony dan Tarek Obaid setelah selesai bermesyuarat pada 8hb September 2009 dahulu.

Namun Shahrol tidak diperkenalkan dengan emel kepada rakan-rakannya dalam usahasama itu sehingga 18hb bulan itu. Pada 30hb, setelah selesai mesyuarat ringkas di London, urusniaga itu ditandatangani tanpa sebarang penilaian dan pemeriksaan yang sempurna oleh PetroSaudi sebelum dikemukakan kepada Lembaga Pengarah 1MDB.

Dalang usahasama itu dipacu oleh Jho Low (lihat berikut) sebelum dia menasihatkan Shahrol di masa hadapan untuk mengecualikannya dari terbabit langsung dalam perkara-perkara 1MDB.

Emel-emel PetroSaudi berikut menunjukkan bahawa dia terus bertindak selaku penyalur rahsia bagi semua tukaran yang dikendalikan oleh para pengarah PSI, Tarek Obaid dan Patrick Mahony.

Tarek has asked me to answer on his behalf as he is not able to get to a computer at the moment. First of all regarding the overview of PetroSaudi, I attach a brief presentation. This is a bit dated and only includes the upstream oil and gas ambition of PSI (it also does not have any asset specific data) but should give you a sense of what we are about. Obviously PSI will aim to invest in other areas as it works with you going forward.

With regard to liaising with Robert on what we can release to the media, I will be the point person. I would suggest you send to me a draft of what you would like to release and we will let you know if it works for us. PSI is very press shy and usually never announces our investments (one of the main reasons governments like to work with us) but we understand you will need to make some statements and we would be happy to make them jointly with you.

PetroSaudi International Limited and 1Malaysia Development Berhad in US$2.5 billion joint venture Partnership, opens new door to FDIs

KUALA LUMPUR, 30 September 2009: Malaysia and Saudi Arabia today entered a new era of economic cooperation with the setting up of a US$2.5 billion joint venture company, which will spearhead  flow of foreign direct investments from the Middle East as well as well as make strategic investments in high-impacts projects here.

The joint venture company (“JVC”) is the result of a partnership between Malaysia Development Berhad (“1MDB”) and PetroSaudi International Limited (“PSI”)

This venture is the first undertaken by PSI in this region and underscores the confidence Saudi Arabia has in Malaysia and economic prospects here.

The 1MDB is wholly owned by the Government of Malaysia and was established recently to drive strategic initiatives for long-term sustainable economic development and promote in flow of FDI into the country.  PSI, based in Al-Khobar, Saudi Arabia, is mandated to carry out investments which can strengthen the relationships between the Kingdom of Saudi Arabia and key countries worldwide.
The JVC’s objective is to seek, explore, and participate in business and economic opportunities which results in the enhancement of and promotion of the future prosperity and long-term sustainable economic development of Malaysia. It is also expected to actively make investments in the renewable energy sector.

The JVC is also expected to be a vehicle for investments from the Middle East into the region, thereby giving Malaysia the edge in drawing investments from the cash and resource-rich region.

Joint Press Statement by PetroSaudi International and 1Malaysia Development Berhad

PetroSaudi International Limited and 1Malaysia Development Berhad in US$2.5 billion joint venture Partnership, opens new door to FDIs

KUALA LUMPUR, 30 September 2009: Malaysia and Saudi Arabia today entered a new era of economic cooperation with the setting up of a US$2.5 billion joint venture company, which will spearhead  flow of foreign direct investments from the Middle East as well as well as make strategic investments in high-impacts projects here.

The partnership between Malaysia Development Berhad (“1MDB”) and PetroSaudi International Limited (“PSI”) involves the creation of a joint venture company (“JVC”) with an initial capital of US$2.5 billion in which 1MDB and PSI will be contributing US$1.0 billion and US$1.5 billion in equity respectively.

This venture is the first undertaken by PSI in this region and underscores the confidence Saudi Arabia has in Malaysia and economic prospects here.

The 1MDB is wholly owned by the Government of Malaysia and was established recently to drive strategic initiatives for long-term sustainable economic development and promote in flow of FDI into the country.  PSI, based in Al-Khobar, Saudi Arabia, is mandated to carry out investments which can strengthen the relationships between the Kingdom of Saudi Arabia and key countries worldwide.
The JVC’s objective is to seek, explore, and participate in business and economic opportunities which results in the enhancement of and promotion of the future prosperity and long-term sustainable economic development of Malaysia. It is also expected to actively make investments in the renewable energy sector.

The JVC is also expected to be a vehicle for investments from the Middle East into the region, thereby giving Malaysia the edge in drawing investments from the cash and resource-rich region.

PSI’s Chairman HRH Prince Turki Bin Abdullah Bin Abdulaziz Al-Saud said: “Malaysia has long been a model of stability and development for developing countries. We believe that recent economic liberalisation
policies announced by the Prime Minister will only make Malaysia a more attractive place for investors. We envisage Malaysia becoming an important partner for the Kingdom of Saudi Arabia.”

Also lauding the setting up of the JVC was 1MDB’s Chairman Dato’ Mohd Bakke Salleh.
He said: “The JVC is set to further increase foreign direct investment from the Middle East, in particular Saudi Arabia. We will leverage on PSI’s strong international presence, their networks and expertise to
promote Malaysia as the preferred investment destination.”

The JVC will initiate various projects in multiple sectors which are mutually beneficial as well as in line with 1MDB’s mission to drive long-term sustainable economic development in Malaysia.

Ok. I’ve just been bbm’ing with jho and i think we need their counsel to stay longer in case. I also need to get the 1mdb lawyer and my lawyer in touch asap. I will wait until you send the jva but what i suggest is that when you send me the jva, you introduce me to your lawyers by email and then i will forward the jva to my lawyers and introduce my lawyers to your lawyers. Jho is tied up in meetings and could not do the call.

He requests that you bcc himself and me in any correspondence to 1MDB.

Also, the meeting on Wednesday is expected from 11am to 5pm. Can you get White and Case to book 2 meeting rooms. 1 for 1MDB and PSI. 1 for Jho and PSI.

Jho has softened the ground so the 1MDB ppl are expected to come and meet, chat to know each other and sign. Their legal counsel will be here as well.
