We can  now confirm that the people jailed for protesting against the Chief Minister’s sister’s company, Quality Concrete, logging in their Native Customary Lands have be released after sizeable protests outside the police station in Simunjan where they were being held. They had been accused of allegedly setting fire to the logging camp, but there is no evidence to back this claim.

In a recent story Sarawak Report exposed the shocking attempt by the firm Quality Concrete to force Iban villagers to hand over their rights to 3,035 hectares of Native Customary Rights Lands in Sebangan for just MR 250 (US$ 80) per family.

The company, of which the Chief Minister’s sister Raziah is one of the Directors,  is after the millions of dollars-worth of rare and valuable hardwood trees in the area.  However the Ibans are refusing, saying they want to preserve their forest for future generations.

Now, the leading protesters named in that story have been thrown in jail on the pretext of a fire that broke out at Quality Concrete’s logging camp on Monday.  There is no evidence about what happened, however ten local people were originally arrested and three have still not been released: these are Numpang Suntai, a retired worker for Shell; Nicholas Mujah, who runs Sadia, an NGO supporting Dayak rights and one of the local headmen, Tuai Rumah Sadon ak Ason. 

There is no evidence against any of these men yet the political motives are clear.  Both Suntai and Mujah have been helping the locals with their vocal campaign and they have supported villagers who carried out a blockade against illegal logging by the company in their territory.  Yet neither were anywhere near the outbreak of the the fire and it is clear their arrests are purely a response to their legitimate protests on behalf of their community.  The pair came to Simunjan local police station in answer to a request by the local police chief, DSP Choo Yin Kok, whose telephone number  is 082 803779, Mobile : 019-8583016 and have not been released.

So who are the real criminals?

There is no evidence that local people were behind the fire.  Indeed, since Quality Concrete’s provisional licence to log the area runs out next month, the motivation on their side is arguably stronger in terms of a potential insurance pay out.  Meanwhile, the logging camp itself remains illegal and Sarawak Report has documents showing that Quality Concrete has been banned by the Forest Department from carrying out further logging in the area until and unless the dispute is settled. 

Therefore, Sarawak Report and several local and international NGOs are questioning on what grounds are these people being held?

Abuse of power

Behind this scandal lies the malign influence of Raziah Mahumd, one of the Directors of Quality Concrete.  She is the sister of Chief Minister, Abdul Taib Mahmud, and she has like the rest of the family has built her vast fortune from exploiting her access to planning permits via her brother who controls them.  The only reason for having Raziah on the board of Quality Concrete, which is otherwise owned by the Sibu-based Tiang family, is that it is through her that they will have got the permit.

In return Raziah and her brother Taib will get their sizeable cut of the profits.  Timber industry insiders have testified to Sarawak Report in considerable detail how the system works and we estimate that the Chief Minister and his sister stand to make several hundred million ringgit out of the destruction of this area, which they are then planning to turn over to Oil Palm plantations.

Things have gone too far in Sarawak

The scandal of what is happening in Sebangan is a sign that the Mahmud family have lost all sense of reason and proportion in their continuing mismanagement and plunder of Sarawak.   In this case Raziah and her brother have been caught with their fingers in the till, stealing what is not theirs.  Their reaction has been to bring in the police to persecute those who are standing up to their corrupt practices.

Of course this is not the first time Sarawak’s ruling family has done any of these things, but their record is catching up with them and the glare of world publicity is on them.  We are just one week after the Sibu river disaster which Taib’s own Deputy and ‘Chief Cheer-Leader’, James Masing acknowledged was a man-made catastrophe caused by illegal logging allowed by Taib’s regime – a key sign that the old man is losing his grip.

So who is acting illegally? This letter from the Director of Forests to Quality Concrete demanding they suspend activities in Sebangan until the dispute with locals is settled has been ignored by the company.

What is more, Sarawak Report’s original report on Raziah’s raid on Sebangan was networked across the globe to concerned groups and publications and received a huge response online.  The issue of the Ibans of Sebangan has also sparked a campaign in the United States and their plight has become a symbol of the corruption and injustice of Taib’s government.  

Tonight, a distraught Christina Suntai, Numpang’s sister in Florida, called Sarawak Report to say he and his innocent friends are still in jail. “My brother has never done anything wrong, he is totally honest, all he has ever tried to do in his life is good”, she explained.  If only the same could be said for the current rulers of Sarawak! 

Surely the Federal Government, which has charge of the police, must intervene in the name of good sense and prevent this abuse of power and symbolic example of rampant corruption in Sebangan?   To allow innocent protesters, who are of high-standing in their communities, to remain in jail in such a public case can only reflect even more badly and counter-productively against Taib and his faltering grasp of reality.

    The only "crime" my brother Numpang did in this scenario is because he was helping our relatives in Sebangan to fend off the illegal loggers, Quality Concrete Holdings from destroying our native customary rights lands and forests. He called me before he surrenderd to the Police and said, "If anything happened to me, at least I know I am doing something good to help our relatives." My brother is not a well man and I hope they will let him take his heart medication properly as he does have irregular heartbeats. 13 years ago he had a stroke and he still cannot make use of his left hand or even knot his own tie.

    My brother is a good man and never commit a crime in his life. He is taking care of our 97 father who is waiting anxiously for his return. He is very popular and well loved by all his family, his siblings, his nieces and nephews, aunts, uncles, cousins all the relatives from Sebuyau to Sebangan and from Sadong to Debak and Sibu.

    He just retired and was enjoying a good easy life away from the hustle bustle of the coperate world. But he and his wife Helen, cannot be just a bystander while the wanton destruction our NCR forests happened right before their eyes.

    We all know that evil things happened when good men remain silent. Numpang and Helen refused to remain silent.

    Make no mistake, we will never let other people say this about the Iban tribe of Borneo "Iban punya bodoh" or "Iban punya takut." Meaning,"Ibans are stupid." "Iban are cowards"

      Christina, your brother, Numpang is a towering Sarawakian and deserves all our support. Taib must go together with all his co-horts. George Chan is a sure gone case but not sure how Jabu, Masing, Mawan and their running dogs will fare. They have betrayed their own race by keeping silent and looking out for themselves only. We pray God protects Numpang and the rest and severely punishes the betrayers.

        I really sympathised to your brother after I have read your comment. This is a good spirit and couragement that your brother has shown and that we need to follow in defending our right. We used to hear about freedom here and there in our country and why do they catch us like rats even they are the real culprit. Who are they if not us. I hope that if we need to enjoy freedom, we must make some change in the future. It's all at our finger tip.

      I remember the wording from our national anthem "Tanah tumpah nya darah ku". Land for the dayak is life. You take away their land, you're taking away their life. In history, you name it…Benito Mussolini, Hitler, Marcos, etc… even how powerful and rich a human can be…their death are of hatred and curse to their children.       My uncle Numpang has been the cause of change to his community no matter whether he is there or in Miri. I remember the time his leadership in building salt water tide protection system in Bajong. As a result, farming in the area flourished as the village could control the salt water from coming in. My point is he continues to do so even at the time he and My Aunt Helen should retire and have a more relaxed life.

      By putting him in jail is one of the common tactic to harass him and his family. It is very sad that we always thought that our country is different from Indonesia or Burma. In fact we are in the same situation at different scale. I remember one comment by an Iban policeman. He said "one day we will be sent to arrest or worse, to hurt my own people that is protesting against this kind of abuse and defending their rights". He said this with great remorse and shows his own view of the credibility of legal system that we have.

      I pray to god to continue to protect My uncle and his family, his team that is defending this and also the supporters. Please give them the strengths to continue their cause and protect them from all evil.

    By supporting the current leaders of BN at our State level, the current situation prevails.

    While we leave the legal side of the case to the lawyers, we must understand politically why this has happened to us now, losing our NCR land not only to forest concessionaires but also to Oil Palm planters etc in the name of Politics of Development.

    Taib and his men have amassed all the current Executive and administrative power because he had successfully destroyed all political opposition by his astute use of money and patronage politics by splitting every race into camps which he then controlled successfully for example let us take the Ibans. They have been split into Pesaka, PRS, SPDP, BERJASA, SUPP, PKR, SNAP and some in STAR. Say the current Iban composition in Sarawak is 30% of the population and are divided just say amongst 6 groups while 5 of them are under Taib's control, effectively having the support of 25% of the Ibans or over 80% of the Ibans alone. Yet when Ulu Niah Ibans were similarly harassed by an Oil Plam planter, they suffered alone.. Now this area the other Ibans allow you to suffer alone…

    It is a political problem which has led to the existing situation. When I shaved my head in 1995-1996 to signal "watch out, one day the people will bald", very few bothered to listen. Instead many joked that STAR equals to "Saya TiAda Rambut". Only when I counter with "Sentiasa Tidak Amal Rasuah", they remain silent.

    I put it to all who read this note, can we continue to exploit our own people with the power they gave to us without FREE, PRIOR and INFORMED CONSENT with impunity?

    I strongly believe that we cannot afford to do it forever. We must develop our State to benefit MORE people not just the privileged few!

      Dr Patau, good that you are aware of Taib's tactics to divide the Ibans and Dayaks as a whole. Now that you are in opposition, it is all the more important that STAR works with Pakatan Rakyat so that opposition votes will not be split.

      As an urban Sarawakian, I can only emphatise with our rural Sarawakians and pray that justice will prevail soon.

    It is a tragedy for the natives to be arrested for protecting their land. When will the government stop giving freebies to fat cats (pigs) who are already filthy rich to be begin with; freebies that they stole from the natives. How can those government officials sleep at night knowing that the rest of the masses live on meager means and could not even stop the government/bandits from taking raping and stealing their land.     I heard the logging camp worker's quarters location and the blockade of the logging area were of both different opposite locations, and of 4 KILOMETERS apart.

    Are we just standing here and watch like there is nothing happen? It is not the government that the people hate. But those who rule the state like a gangters who rob the people on clear broad light. Can we trust them anymore? Can we blame the people to initial protest or even violence which will be a last resort after all proper channel of soft approached not been heard?       problem lies with ourselves. we keep on blaming those in corridors of power i.e. CM & cronies. Have we done our part yet? Have we convince our aging parents, relatives, friends, whom most of them are staying at kampungs, long houses, to vote for change. Have we ever share our passion with them on WHY change is needed? We must remember, their privilege to gain access to all these information have been systematically denied access. And we must remember so long we keep singing the same tune without the involvement of these masses, it will remain status quo. Their votes will remain as fixed deposit for BN. It's just that the consequences of doing those unmasking their real faces. They may avoid the truth but they can't avoid the consequences of avoiding the truth.

      This NCR dispute had started in 2009. There is a pending court case filed against another logging company but why Forestry Department issued another license to another company is beyond my comprehension.

      However, Forestry Department did issue a stop to log order on August 13th 2010 but Quality Concrete Holdings ignored the order but instead bribed some tribal chiefs and then gave the land owners 250 ringgit ($80USD) to log and bulldozed their land for timber. The bulldozing and trespassing also included other property owners who did not take the money! But it did not stop there, Quality Concrete Holdings went ahead bulldozing their way all the way to Selabu and penetrated the "kampong galau", community forests and that was when they decided they must physically form another blockade. So that was reason why my brother Numpang and the villagers decided to camp out in the jungle and physically blocked the bulldozers and backhoes from moving any further into the Native Customary Rights forest.

      They had in the past complained to the Police about the trespassing and illegal logging but for whatever reasons, the complaints were ignored with "There is nothing we can do."

      This logging company, Quality Concrete Holdings, because of their connection to the powerful CM Taib Mahmud whose sister was the non-executive director of the company, was operating under the assumption that laws do not apply to them and little people, like my relatives in Sebangan can be bullied and stepped on and the logging company have no respect basic rights of the Ibans in Sebangan!

      Much as I am scared of the consequences for standing up against the powerful Chief Minister of Sarawak and his cronies, I too, like my brother Numpang and the rest of my relatives in Sebangan we decided to stand up for our rights. We are not, I repeat NOT against the government, we are against the illegal logging and the destruction of our property. Enough already.

      How do you feel if someone came to your farms and started stealing your crops and refused to stop even though you had confronted them times and times again, to cease and desist?

      I couldn't agree more Mike. I have known Numpang for over 30 years. He is a peace loving, good and caring man. Not to meniton in this case innocent! He is just trying to keep the land that is rightfully the Ibans that is being stolen away from them because of Greed. It is clear to us all on the outside looking in what is happening here.     This is what Taib's family learnt from Colonial Government. Hide the truth. Capture who knows the secret. Exactly just like Rosli Dhoby time whereby his birth cert was amended so that he can be trial as adult. At anytime, Taib can change NCR land to other so that it'll be legal.

    The issuance of the licence was on 30th Nov.2009 and will expire on 30th Nov.2010.will it be renewed after the expiry date? It is everybody's guess. But I think the authorities concern (be they the Forest Dept, The Land & Survey or any powerful individuals will always be kind to this QC and surely extend the licence. What really sadden me and my fellow Sebangan/Sebuyau Ibans is the coward attitude of our Dayak YBs who dare not speak out about the action of these poor Sebuyau/Sebangan Iban to condemn or let alone support them.

    You are right Peter, just bunch of cowards making a living as YBs but no real concern for the people.

    We cannot totally blame the Forestry Department because this Department did in fact write a letter to Quality Concrete Holdings on August 13th 2010 to stop. Quality Concrete Holdings refused to stop because the rules of law do not apply to them. They knew they would not be arrested by the Police. When my brother Numpang heard about it, he called the Police in Sebuyau and they Police in Sebuyau told him there was nothing they can do. Numpang then called the Police in Kota Samarahan to complain that Quality Concrete Holdings did not stop taking logs out of our NCR forest, Police in Kota Samarahan told him the same thing, "There is nothing we can do." Then Numpang proceeded to call the Police in Putra Jaya and again he was told that there was nothing they can do to stop the illegal logging activities.

    Then on October 15th the logging camp was burnt and the Police in Simunjan acted very quickly. The first thing they did was visiting my father's "Tempat Jual Minyak" at Sebangan and asked my 97 year old father where Numpang was. My father asked the Police, "Why are you looking for Numpang?" and the Policeman responded, "We want to "tangkap" (arrest)him." My father then responded, “Why do want to arrest my son. Did he do anything wrong?" and at that point the policeman left and muttered to my father saying, "Pura pura tidak tahu." Numpang was in Kuching seeking medical treatment for a very bad cold and getting his heart medication and was not at my father's shack at that time.

    On October 22nd Malaysian Mirror, a local news media, "Timber Camp burnt destroyed by Protester." I was shock! Just a few hour ago I was talking to my brother and he did not hear of the fire until Joseph Tawie from Free Malaysia Today called him and told him about it.

    The point that I am going to make is first, the Police reacted very quickly wanting to arrest my brother. Yet "Nothing we can do" response to Numpang when he called them about Quality Concrete Holdings trespassing on Native land and stealing trees from our forest.

    Second point I am going to make here, why did Malaysian Mirror make such a blatant headline and already condemning the protestor by saying "Timber Camp burnt destroyed by protester." People are innocent until proven guilty. Nice attention grabbing headline at the expense of the Ibans in Sebangan and I am very upset about it! I am protesting against Malaysian Mirror condemnation of the my relative who stood up and protested against illegal loggers. Please, we Ibans are not "bodoh" you know, enough already!

    They are getting too complacent with their unlimited earnings and they think they can get away easily by slowly sweeping the issues under the rug. Just like always and like any other "sensitive" issues.

    OR, in this case, they would turn the story around to blame the innocent victims to cover their tracks. They know they getting into trouble so they tried to make the other villagers as the protagonists which in fact, they are the one are the bad guys in the real picture!

    Although this is a known fact, the people are not brave enough to voice out or to question as they fear for security and personal benefits.

Sudah tentu perkara seumpama ini segaja tidak di selesaikan , sebab mungkin semua wakil rakyat yg kita beri undi kini bn , ada bersokol sama. Tidak ada wakil rakyat di bawah lambang dacing yg hidup nya sederhana melainkan dengan kehidupan yg mewah dan bergaya . Persoalan kita dari mana sumber keawangan mereka , kalau tidak dari sumber pengambilan tanah ncr, dan kayu balak, dan lain lagi. Dengan penindasan yg cukup terang dan nyata, apakah rakyat sarawak, masih menaroh harapan kepada pemimpin dan angota bn dalam state election mendatang ??       There are two tribal leaders in the Sebangan area that should be in jail for taking bribes, scaring and manipulating natives to take the 250 ringgit for selling their rights to ownership.

      I have proof that Penghulu Merom anak Baru and Tuai Rumah Agu anak Kaleng took the bribe money and were dined and wined in Sibu. They signed an agreement with their signatures and Identity Card numbers and took at least 800 ringgit each from the logging company. They are the ones who should be jailed for corruption. They should be removed from their position immediately. Instead of helping the natives, they bullied them into taking 250 ringgit and sold the rights of other people's property to the logging company. Instead of protecting Native Rights, they took bribes and helped the logging company destroying the native forest. Together with the logging company, they are liable for the extensive property damage in the millions ringgit in Ulu Sebangan.

    When I had a heart bypass in IJN, Kuala Lumpur, Numpang and wife visited. No relatives of mine from Miri did that. And he has no blood connection to me neither he was a really close friend.He can't be a bad man. Nobody in Shell could recall if he ever did anything bad within the company or outside. He reported the lodging activity to the police because he thought that is the right thing or he thought that is the right channel. He wouldn't go about burning those timber company because he knew that would be stupid especially when he is the one who lodged the report. If indeed it is the work of the village people, he can't be blame too because he can't be controlling their emotion. The anger is already there even without Numpang in the picture. What if the burning is the work of the company, so that they have an excuse to arrest people who are potentially a problem for them.

    I've tried to refrain myself from getting involved in so called "sensitive issues" as defined by the powers to be and stay away from politics. That is the problem with most of us, we have established comfort zones for ourselves and turn a blind eye on injustice and opression that has grown like a cancer, right infront of our very eyes. Putting aside the fact that I know Numpang Suntai and his wife Helen to be peace loving people who have left the corporate world in order to contribute to the society, I am compelled to add my voice to the already loud chant for change for my love of Sarawak and our country Malaysia.

    The livelihood and survival of the Dayaks depend on 2 things; education and the NCR. With due respect to the longhouse folks, getting access to good education for their children is too competitive and too expensive for most who live far below the poverty line. If the NCR is taken away from them to feed the rich, they will be pushed to a corner where they have no choice but to react and defend their turf. It only takes a few Numpangs of this world to start the ripple of change that will form a huge wave that will not cease until the injustice has stopped and the oppressors defeated.

    We must help the less knowledgable folks at home to tell them their rights, the rights to choose their representatives who will speak and act for them and not against them. We must exercise our rights to install a government who will protect the interests of the Rakyat to govern the Country and the State. Give the government the 5 year contract and review their performance. We, as the Rakyat, are the ones who decide whether the contract should be renewed or a better government installed.

    Let's act now to excersise our rights and support those who fight for the truth. Let's start the ripples within our circle of influence and work together to generate the wave of change. To those who have been entrusted the amanah by the Rakyat to govern the country, please change; otherwise you will be changed.

    My prayers will be with Numpang and the others who have been jailed for a good cause.

    Thank everyone for your support. It's good to know that there are others out there who care.

    I do not plan to be the hero nor seek publicity. I just cannot sit and do nothing when our lands & crops are being destroyed & our timbers stolen right in front of our eyes. The destruction of our lands, forest and rivers means the destruction of our way of life. It means our further descent into the abyss of wretched poverty.

    On my arrest on 22 Oct, all the 120+ protesters who took part in the blockade went to Simunjan Police Station & offered to be arrested. But only those perceived as leaders were take-in. Again on our release on 25th Oct, about 300+ showed to show their support. They came not only from Sebangan area but also from all over Samarahan. The point is that the people are sick of this injustice.

    Update: The seven protestors to include my brother Numpang were released from Police Custody on October 25th 2010. At this point I am not sure what the situation is and according to their lawyer, they have not been charged with anything crime.

    However, they will have to report back to the Simunjan Police Station on November 25th. They may need a good legal team to fight accusations and allegations made against them by Quality Concrete Holdings logging company who are well connected to the richest and most powerful families in Sarawak.     Im not suprise, this evil have use same tactic againts my grandfather and others people for defend our forest in Pakan Sarawak, They said our elder burn their store in logging camp, this accident happen 10 years ago, im still young to understand this evil politician..     like i say "change the goverment for our future and our family future.thats enought for this corruption goverment we should choose new Goverment like PKR.Hopely the new goverment will take care our people.
